Please read these Terms and Conditions carefully before using our Service. By accessing or using www.arlades.com ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use the Service.

1. INTERPRETATION AND DEFINITIONS

1.1 Interpretation

Words with capital letters have meanings defined below. These definitions apply whether they appear in singular or plural form.

Website/Service: www.arlades.com, including all related mobile websites and applications

Products: Premium European marble, natural stones, hardscape materials, and landscape design elements sold through the Website

Services: Hardscape planning and design, professional stone laying, and landscape consultation services

Order: Your request to purchase Products or Services from us through the Website

You/User: The individual or entity accessing or using the Service

Device: Any device that can access the Service (computer, smartphone, tablet, etc.)

2. USER ELIGIBILITY

2.1 Age Requirement

You represent and warrant that you are at least 18 years of age. We do not permit anyone under 18 to use the Service. If you are under 18, you must not access or use this Website.

2.2 Jurisdiction

The Service is intended for users located in India. We reserve the right to restrict access to the Service in any jurisdiction at our sole discretion.

3. PRODUCTS AND SERVICES

3.1 Description

We offer premium European marble artifacts, natural stones, hardscape materials, and professional landscape design and installation services.

3.2 Product Information

While we strive to provide accurate descriptions, photographs, and specifications on our Website, we do not warrant that descriptions, photographs, pricing, or other content are complete or error-free. If a Product offered by us is not as described, your sole remedy is to return it in accordance with our Return Policy (Section 8).

3.3 Natural Material Variations

All Products are natural materials (marble, stone, etc.) and may include natural variations in color, veining, texture, finish, and grain. These variations are inherent to natural stone and do not constitute defects. Variations in color and pattern should be expected and accepted when ordering natural stone Products. We strongly recommend viewing samples before placing large orders. By ordering, you acknowledge and accept these natural variations.

3.4 Customization & Design Services

For custom design services, we will provide initial design proposals and quotations. You may request changes up to two rounds of revisions. Additional revisions will incur additional charges as mutually agreed. Once you approve the final design and we proceed with manufacturing, changes may not be possible and no refund will be available.

All original design concepts, drawings, and renderings created by us remain our intellectual property. You may use them for your personal use only. Reproduction, distribution, or commercial use is prohibited without written consent.

4. PRICING AND PAYMENT

4.1 Pricing

All prices displayed on the Website are in Indian Rupees (INR) and include applicable GST unless otherwise stated. Prices are subject to change without notice. We reserve the right to correct any errors in pricing that appear on the Website.

4.2 Payment Methods

We accept payments through:

• Credit cards (Visa, Mastercard, American Express)

• Debit cards

• Net banking

• UPI and digital wallets

• Bank transfers

4.3 Payment Processing

Payment processing is handled by our third-party payment gateway (Razorpay). By making a payment, you authorize us to charge your payment method. Your card details are not stored on our servers and are processed securely by the payment gateway provider.

4.4 Payment Timing

For standard orders, full payment is due upon order placement.

4.5 Taxes

Prices include Goods and Services Tax (GST) as per applicable Indian law. A tax invoice will be provided with your Order.

5. ORDERS AND DELIVERY

5.1 Order Placement

By placing an Order, you are making an offer to purchase the Products or Services. We reserve the right to accept or reject any Order at our sole discretion. An Order is confirmed only when you receive written confirmation from us via email.

5.2 Delivery Timeline

Standard delivery timelines are as follows:

• Stock items: 15-30 business days from confirmed order

• Custom orders: 4-8 weeks from design approval and advance payment

• Installation services: As per agreed schedule

Delivery dates are estimates and not guarantees. Delays may occur due to circumstances beyond our control. We will make reasonable efforts to notify you of any delays.

5.3 Delivery Address

You must provide accurate delivery address information. We are not responsible for failed deliveries due to incorrect or incomplete addresses provided by you.

5.4 Shipping Costs

Shipping costs will be calculated based on weight, dimensions, distance, and delivery location. Shipping costs are in addition to the Product price and will be displayed before you complete your Order. Heavy or bulky items may incur additional charges.

5.5 Risk and Title

Title to Products remains with Arlades until full payment is received. Risk of loss or damage to Products passes to you upon delivery to the logistics partner, unless installation services are included, in which case risk transfers upon completion of installation.

5.6 Inspection

You must inspect Products upon delivery and report any visible damage or defects within 48 hours. Claims for damaged or defective Products made after 48 hours cannot be entertained.

6. CANCELLATION AND REFUND POLICY

6.1 Cancellation by You

You may cancel your Order within 7 days of order placement as per the Consumer Protection Act, 2019. Cancellation requests must be submitted in writing to contact@arlades.com.

For custom or made-to-order Products, cancellation is not permitted after design approval and commencement of manufacturing.

6.2 Refund Eligibility

Refunds are available for:

• Cancellation within 7 days of order (for non-custom items)

• Defective or damaged Products (reported within 48 hours of delivery)

6.3 Refund Ineligibility

Refunds will NOT be available for:

• Natural variations in color, texture, or grain (inherent to natural stone)

• Custom or made-to-order Products (once manufacturing has commenced)

• Products damaged due to mishandling, improper storage, or installation by third parties

• Change of mind after 7 days

6.4 Refund Process

Upon approval of a refund request:

• We will arrange pickup of the Product at your cost

• Refund will be processed to your original payment method within 14 days of receipt and inspection

• Bank processing times may add 3-5 additional business days

6.5 Cancellation by Arlades

We reserve the right to cancel any Order if Products are out of stock, due to technical errors, or violation of these Terms. In such cases, full refund will be issued.

7. WARRANTIES AND DISCLAIMERS

7.1 Limited Warranty

We warrant that:

• Products delivered are as per the agreed specification

• Products are free from manufacturing defects

• Services are performed in a professional manner

7.2 Warranty Period

Warranty covers manufacturing defects for a period of 12 months from the date of delivery. This warranty does not cover natural variations, normal wear and tear, or damage from mishandling, improper installation, or external factors.

7.3 Disclaimer on Product Use

We provide no warranty regarding the suitability of Products for your specific use case. You are responsible for ensuring that Products meet your requirements. We recommend consulting with a professional designer or architect before placing large orders.

7.4 "AS IS" Disclaimer

Except as expressly stated in Section 7.1, the Website, Products, and Services are provided "AS IS" and "AS AVAILABLE" without any warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.5 Third-Party Products

For Products from third-party suppliers, warranties from the original manufacturer apply. We act as intermediaries and are not responsible for the quality or performance of third-party products. You may claim directly from the manufacturer or supplier as applicable.

8. LIMITATION OF LIABILITY

8.1 Limitation

To the maximum extent permitted by law, our total liability under these Terms shall be limited to:

• The amount actually paid by you for the Product or Service, or

• ₹ 5,000 (Five Thousand Rupees) if no purchase has been made

8.2 Exclusion of Consequential Damages

In no event shall Arlades be liable for any:

• Indirect, incidental, special, or consequential damages

• Loss of profits, revenue, or anticipated savings

• Loss of data, business interruption, or loss of goodwill

• Damages arising from delay in delivery or services

This limitation applies even if Arlades has been advised of the possibility of such damages.

8.3 Consumer Protection Act

Nothing in these Terms shall exclude or limit liability that cannot be excluded or limited under the Consumer Protection Act, 2019. If you are a consumer as defined under applicable law, you may have rights that cannot be waived.

9. INTELLECTUAL PROPERTY RIGHTS

9.1 Ownership

All content on the Website including text, images, photographs, designs, logos, and artwork ("Content") are the intellectual property of Arlades or its licensors and are protected by copyright laws.

9.2 License

You are granted a limited, non-exclusive, non-transferable license to view and download Content for personal, non-commercial use only. You may not reproduce, distribute, transmit, modify, or display Content without our written permission.

9.3 Design Concepts

All design concepts, sketches, renderings, and technical drawings created by us remain our intellectual property. You may use them for your personal project only. Reproduction, publication, or commercial use is strictly prohibited without written consent.

10. USER CONDUCT AND PROHIBITED ACTIVITIES

You agree not to:

• Violate any applicable laws or regulations

• Infringe upon our intellectual property rights

• Copy, scrape, or systematically retrieve data from the Website

• Attempt to gain unauthorized access to the Website

• Transmit viruses, malware, or harmful code

12.1 No Responsibility

The Website may contain links to third-party websites. We have no control over and assume no responsibility for the content, policies, or practices of any third-party websites.

12.2 Your Responsibility

13. FORCE MAJEURE

We shall not be liable for any failure or delay in delivery or performance of Services due to circumstances beyond our reasonable control, including but not limited to:

• Natural disasters, pandemics, or epidemics

• War, civil unrest, or government action

• Strikes, labor disputes, or supply chain disruptions

• Logistics partner failures or transportation unavailability

In such cases, we will make reasonable efforts to notify you and provide revised delivery timelines.

14. INDEMNIFICATION

You agree to indemnify and hold harmless Arlades, its affiliates, officers, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms, your use of the Website, or your purchase and use of Products or Services.

15. DISPUTE RESOLUTION AND GRIEVANCE REDRESSAL

15.1 Informal Resolution

If you have any complaint or dispute regarding the Website or Products/Services, you agree to first contact us informally at contact@arlades.com or via the contact form on the Website. We will make reasonable efforts to resolve the matter within 30 days.

15.2 Formal Grievance

16. GOVERNING LAW AND JURISDICTION

16.1 Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, including but not limited to the Consumer Protection Act, 2019, the e-Commerce Rules, 2020, and the Information Technology Act, 2000.

16.2 Jurisdiction

Both parties agree to submit to the exclusive jurisdiction of the courts in Gurugram, Haryana, India. This is without prejudice to your rights under the Consumer Protection Act, 2019 to file proceedings in any other competent court as allowed by law.

17. SEVERABILITY

If any provision of these Terms is found to be invalid, unenforceable, or illegal by any court, that provision shall be modified to the minimum extent necessary to make it valid, or if not possible, shall be severed. All other provisions shall remain in full force and effect.

18. MODIFICATIONS TO TERMS

18.1 Right to Modify

We reserve the right to modify these Terms at any time. If changes are material, we will provide at least 30 days' notice via email (if you have an account) or by posting a notice on the Website.

18.2 Acceptance

Your continued use of the Website after modifications become effective constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Website.
